Postnuptial Agreements
A postnuptial agreement is similar to a prenuptial agreement; however, it is entered into after the parties are married. Like a prenuptial agreement, it focuses on the division of property, debts and assets should a marriage end in divorce. It can also include provisions regarding spousal support and inheritance for a child of a former spouse. Other reasons for creating a postnuptial agreement include changes in circumstances such as a spouse starting a new business or a spouse becoming financially irresponsible. When infidelity has been an issue in a marriage, one spouse may want to have a postnuptial agreement in place in case the infidelity occurs again and the marriage needs to end. A postnuptial agreement can also modify terms in a previously executed prenuptial agreement.
